Terms and Conditions for Sachiv

This document is an electronic record in terms of the Information Technology Act, 2000, and rules made thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and terms of use for access or usage of the platform.

Scope

These Terms of Use ("Terms") govern the usage of the Sachiv mobile application and website ("Platform") operated by Algofast India Pvt. Ltd., a company incorporated under the provisions of the Companies Act, 2013, with its registered office at 501, 3, Adarsh Complex Community Center, Wazirpur Industrial Area, Ashok Vihar, Delhi, 110052, India ("We," "Us," or "Our"). These Terms outline the usage policy governing the Platform and the services provided through it ("Services").

By accessing or using the Platform or Services, you ("User" or "You") expressly agree to be bound by these Terms. Your use of the Platform and/or Services constitutes acceptance of these Terms from the point of usage. If you do not agree with these Terms, you may not use the Platform or Services.

We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time without prior written notice. Such changes will be posted on the Platform, and it is your responsibility to review these Terms periodically for updates. Your continued use of the Platform after such changes constitutes acceptance of the amended Terms.

Definitions

For the purpose of these Terms, wherever the context so requires, the term:

'User' shall mean any individual or entity who accesses or uses the Platform for availing the Services.
'Services' shall mean the functionalities provided by the Sachiv mobile application, including but not limited to personal productivity tools or other features specific to Sachiv.
'User Account' shall mean the account created by the User on the Platform in accordance with these Terms.
'User Information' shall mean the information provided by the User for the purpose of creating and maintaining the User Account.
'User Account' shall mean the account created by the User on the Platform in accordance with these Terms.
'Payment Instrument' shall mean any electronic or written instrument or order for the transmission or payment of money, including but not limited to credit/debit cards, UPI, or other electronic payment methods.

Additional terms used herein shall have the meanings assigned in the relevant sections below.

1. Services Provided

The Services provided by Sachiv include personal productivity tools and related functionalities. We act as a technology platform facilitating these Services. We assume no liability for the actions of third parties involved in the Services, except as expressly stated in these Terms.

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted or error-free operation of the Platform, and you assume all risks and costs associated with your use of the Services, including any damage to your device or data loss.

2. Use Account and Registration

Account Creation

Before availing the Services, you must complete the registration process as prescribed on the Platform. You shall provide accurate, complete, and up-to-date User Information to create a User Account.

Account Security

You are responsible for maintaining the confidentiality of your User Account Information and for all activities under your User Account. You agree to notify us immediately of any unauthorized use or security breach. We are not liable for any loss or damage arising from your failure to keep your User Account Information secure.

Account Suspension/Termination

We reserve the right to suspend or terminate your User Account, with or without notice, if:

The User Information provided is incorrect, incomplete, or doubtful.
Your account is involved in suspicious or unlawful activities.
You fail to comply with these Terms.

You shall indemnify us against any losses or claims arising from incorrect User Information or failure to validate your account promptly.

3. User Responsibilities

You represent and warrant that:

All User Information provided is valid, complete, true, and correct and will remain so during your use of the Platform.
You will comply with all applicable laws and bear liability for any breach thereof.
You will not use the Services for any unlawful purpose or in a manner that:

Infringes third-party intellectual property rights.

Transmits harmful content, including viruses or malicious code.

Engages in activities that are defamatory, obscene, pornographic, or otherwise unlawful, including money laundering or gambling.

Violates privacy, threatens public order, or misleads others.

You shall maintain independent records of all transactions conducted on the Platform and provide them to us upon request.

4. Fees and Payments

You agree to pay all applicable fees and charges for using the Platform and Services, as specified on the Platform. Fees are non-refundable and subject to change, and it is your responsibility to review the current fees periodically. All payments must be made in Indian Rupees through the payment options provided on the Platform.

We are not responsible for any loss or damage arising from:

Unauthorized transactions.
Exceeding preset limits with your bank or payment institution.
Payment issues or transaction rejections.

Non-payment of fees may result in suspension or termination of your User Account.

5. Intellectual Property

All rights, title, and interest in the Platform and Services, including copyrights, trademarks, and other intellectual property, are owned by or licensed to Algofast India Pvt. Ltd. You are granted a non-exclusive, non-transferable, revocable, royalty-free license to use the Platform and Services in accordance with these Terms.

You may not:

Copy, modify, distribute, or create derivative works from the Platform or Services.
Use the Platform's content without retaining copyright notices.
Share, publish, or reproduce Platform content on any other medium without our prior written consent.

Any infringement may lead to legal proceedings under applicable laws.

6. Third-Party Links and Services

The Platform may contain links to third-party websites or services. We are not responsible for their functionality, actions, privacy policies, or content. You are advised to review the terms and policies of any third-party websites before interacting with them.

7. Permissions Granted

By using the Sachiv mobile application, you grant us permission to access certain features of your device as necessary to provide the Services. These permissions include but are not limited to:

INTERNET: To access online services and fetch data.
POST_NOTIFICATIONS: To send you notifications about app updates, reminders, or other relevant information.
CAMERA:To capture images or videos if the app includes such functionality.
RECORD_AUDIO:To record audio if the app includes voice recording features.
WRITE_EXTERNAL_STORAGE:To save files or data to your device's external storage
READ_EXTERNAL_STORAGE:To read files or data from your device's external storage.
SCHEDULE_EXACT_ALARM:To schedule exact alarms for reminders or other timed events.
USE_EXACT_ALARM: To use exact alarms for precise timing.
FOREGROUND_SERVICE:To run services in the foreground, such as music playback or location tracking.
VIBRATE: To vibrate your device for notifications or alerts.

You understand and agree that granting these permissions is necessary for the app to function as intended and to provide you with the Services. You may revoke these permissions at any time through your device's settings, but doing so may limit the functionality of the app.

8. Termination

We may terminate your access to the Platform or Services at our sole discretion, with or without notice, for reasons including:

Breach of these Terms.
Suspicious or fraudulent activity.
Termination of our agreement with third-party service providers.

Upon termination:

Your User Account may be deactivated, and access to the Platform and Services will cease.
All outstanding fees become immediately payable.
Any User content on the Platform will not be recoverable post-termination.

Provisions such as disclaimers, limitation of liability, and governing law shall survive termination.

9. Limitation of Liability

We and our affiliates shall not be liable for any special, consequential, incidental, or punitive damages, or loss of profits, arising from:

Your use or inability to use the Platform or Services.
Data loss or corruption
Third-party actions or omissions.
Bugs, viruses, or other harmful elements transmitted through the Platform.

You acknowledge that your use of the Platform is at your sole risk.

10. Indemnification

You agree to indemnify and hold us, our affiliates, and their respective officers, directors, employees, and agents harmless from any claims, losses, damages, or liabilities arising from:

Your use of the Platform or Services
Breach of these Terms.
Negligence, misconduct, or fraud by you.
Violation of third-party rights

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, in Delhi, India, by a sole arbitrator appointed by us. The arbitration shall be conducted in English, and the decision shall be final and binding. Each party shall bear its own costs.

13. Confidentiality

We will maintain the confidentiality of your personal information as per our Privacy Policy, disclosing it only as required by law or with your consent. Our employees and agents are bound by confidentiality obligations.

14. Amendments

We may amend these Terms at any time by posting the updated Terms on the Platform. Your continued use of the Platform constitutes acceptance of the amended Terms.

15. Miscellaneous

Severability: If any provision is deemed unlawful or unenforceable, the remaining provisions will remain in effect.
Assignment:You may not assign your rights or obligations under these Terms without our consent. We may assign our rights to affiliates or successors without notice.
Notices:All notices to us (other than routine communications) should be sent to support@Sachiv.com.
Third-Party Rights:No third party shall have rights to enforce these Terms.
Translations: The English version of these Terms prevails over any translated versions in case of inconsistency.
